These Terms of Service ("Terms") govern access to and use of the Colorix online color simulator (the "Service"). By using the Service, you agree to these Terms.

2. Scope and Acceptance

These Terms govern your access to and use of the Service. By creating an account, using social sign-in, or otherwise using the Service, you agree to be bound by these Terms.

3. Service Scope

The Service allows users to visualize, test, and manage color simulations and related project assets. Features may vary by simulator instance and configuration.

4. Accounts and Access

• You are responsible for the confidentiality of your account credentials.
• You must provide accurate account information and keep it up to date.
• Social sign-in is optional and subject to provider availability.
• We may suspend access if security, abuse, or legal concerns require it.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, or abusive activities.
• Attempt unauthorized access to accounts, systems, or data.
• Upload content that infringes third-party rights or applicable law.
• Interfere with the Service operation, performance, or security.

6. User Content and License

You retain rights to your uploaded content. You grant Colorix the rights necessary to host, process, and display that content solely to provide and secure the Service.

7. Intellectual Property

The Service, including software, design, and related materials, is protected by intellectual property laws. Except where expressly authorized, no right to reproduce, reverse engineer, or redistribute is granted.

8. Third-Party Services

The Service may interact with third-party services (for example, social identity providers). Their availability, terms, and privacy practices are governed by those providers and remain outside Colorix control.

9. Availability and Changes

We may update, modify, or discontinue features at any time to improve the Service, maintain security, or satisfy legal/operational requirements.

10. Disclaimer

Color simulation output is indicative and may differ from real-world rendering due to device, lighting, and material conditions. The Service is provided on an "as is" and "as available" basis, to the extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Colorix shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, or business interruption arising from or related to use of the Service.

Nothing in these Terms excludes or limits liability where such exclusion is prohibited by law, including in relation to fraud, wilful misconduct, gross negligence, death, or personal injury caused by negligence.

12. Indemnification

You agree to indemnify and hold harmless Colorix from claims, liabilities, damages, losses, and costs (including reasonable legal fees) arising from your unlawful use of the Service, your content, or breach of these Terms.

13. Termination

You may stop using the Service at any time. We may limit or terminate access for violations of these Terms or for legal/security reasons.

14. Governing Law and Jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-law rules. Mandatory consumer protection provisions remain unaffected.

Unless mandatory law provides otherwise, exclusive jurisdiction for disputes arising out of or in connection with these Terms is at the registered seat of Colorix SA, currently Neuchâtel, Switzerland.

We may amend these Terms from time to time. The version published on this page is the current version.
